1. Acceptance of Terms

By registering for and participating in the Pinch Estimating Affiliate and Partner Program (“Program”), you (“Affiliate”, “Partner”) agree to comply with and be bound by these Terms & Conditions. If you do not agree, you must not participate in the Program.

2. Eligibility

• Affiliates must be at least 18 years of age.
• Affiliates must provide accurate and complete registration information.
• A valid PayPal account is required to receive payouts.
• Pinch Estimating reserves the right to approve or reject any affiliate application at its sole discretion.

3. Affiliate Relationship

Participation in the Program does not create any employment, partnership, joint venture, or agency relationship. Affiliates act as independent contractors.

4. Commission Structure

• Commissions are paid as a percentage of qualifying sales, based on the affiliate program selected at registration.
• Commission rates may vary by program.
• Commissions apply only to completed and paid transactions that meet the minimum sale value.
• Commission attribution is tracked via referral links and/or discount codes.

5. Lifetime Referral Attribution

• Affiliates earn commissions on qualifying purchases made by referred customers for the lifetime of the customer account, unless otherwise stated.
• Tracking cookies remain valid for up to 90 days from the initial click.

6. Payouts

• Payouts are issued via PayPal only.
• A 14-day holding period applies before commissions become eligible for payout.
• The minimum payout threshold is $100.
• Commissions are automatically approved unless otherwise stated.
• Pinch Estimating reserves the right to withhold payouts in cases of suspected fraud, abuse, or violations.

7. Promotional Guidelines

Affiliates may promote Pinch Estimating using approved marketing materials.

• No false, misleading, or exaggerated claims
• No implied guarantees or official representation without authorization
• No spam, deceptive practices, or unsolicited bulk messaging
• No bidding on branded keywords without written approval
• No actions that damage the brand’s reputation or trust

8. Discount Codes

• Discount codes may be generated automatically or specified during registration.
• Codes are intended for tracking and promotional use only.
• Unauthorized use or sharing of codes may result in termination.

9. Multi-Level Marketing (MLM)

• MLM features may be enabled within the Program.
• Affiliates may earn commissions from referred affiliates where applicable.
• Manipulation or abuse of MLM structures will result in immediate termination.

10. Data & Privacy

• Affiliate access to referral data may be limited.
• Customer personal information may be partially hidden for privacy.
• Affiliates must comply with all applicable data protection and privacy laws.

11. Termination

• Pinch Estimating may suspend or terminate any affiliate account at any time.
• Fraudulent or non-compliant commissions may be voided.
• The Program may be modified or discontinued at any time.

Legitimately earned commissions that meet payout requirements may still be paid at Pinch Estimating’s discretion.

12. Modifications to Terms

These Terms & Conditions may be updated at any time. Continued participation in the Program constitutes acceptance of the revised terms.

13. Limitation of Liability

Pinch Estimating shall not be liable for indirect, incidental, or consequential damages, including loss of revenue or data, arising from participation in the Program.

14. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws applicable in the jurisdiction where Pinch Estimating operates.
